When considering the division of assets and support, it is essential to understand the tax implications of all the assets thoroughly. For example, a matrimonial house is tax-free. In contrast, RRSPs are taxable.  Ensuring that appropriate tax is applied to all assets and liabilities before you make final decisions on division.

You will also want to ensure that all joint CRA past, present, or future obligations are accounted for, and the person who is responsible is included in your separation agreement.

Business valuators

It is prudent to have businesses valued during a divorce. There are several different structures, some lending more to valuations than others. Suppose it is a simple Holdco with easily defined assets, such as investment accounts, or a simple one-person consulting proprietorship. In that case, there may be little reason to have an evaluation. The financial resolution experts at Fairway will help you determine whether a valuation is necessary. The good news is that if a valuation is deemed necessary, we can keep the cost down. The valuator does not need to prepare to defend in court but must substantiate the numbers to you, your spouse, and other advisers. This way, we can get a reasonably inexpensive quote.

If one party is a shareholder in the company, and there are a variety of assets and complexity to operations, then getting a company valuation is prudent. Stay calm about the outcome of the assessment as there are many creative ways to deal with this kind of asset such that the person running the company can continue to do so without having to make a fire sale. Financial planners

Several designations in Canada speak to being a divorce financial expert. Most of these designations are credible.

Using a mediator with a designation in this area is beneficial. Divorce financial mediators are not financial planners. What they can do is provide you insight into different options around the division of assets and support, as well as consider some of the long-term implications of your decisions.

When splitting assets, it is highly recommended that you work with a financial planner who can advise you on your assets and liabilities and the income you will need to support yourself. Splitting assets often requires a deep dive into what the assets are made up of, including interest accounts, stocks, minority equity positions, etc. These are not apples to apples, and splitting assets based on numbers will be problematic. Some people are more risk-averse and are better off with lower-risk investments such as interest-bearing GICs, and others are comfortable with risk and can take a more volatile side of the portfolio. However, it is essential to understand that there are pros and cons to each, and working with a financial advisor will help you feel confident that what you are doing as far as division and support, will be able to sustain a good lifestyle in the future.

This way, you are better equipped to understand what the law may say about several matters before negotiating.

It is a number one priority at Fairway Divorce Solutions that your outcome is based on your legal rights. The matrimonial laws in Canada are reasonably straightforward. Laws set out child support, spousal support, and division of marital assets. While there may be some complications overall, these laws are set out such that the goal posts for negotiation are pretty narrow, therefore, there is really no basis for a fight. However, it is still prudent to receive independent legal advice before signing your agreement. Using lawyers to come to an agreement is not a good use of time and money as fees and conflict typically will escalate, resulting in you getting less. We know that the outcome using our divorce resolution experts will yield a much better result than going to court, as you will be assured to have an agreement that is in your best interest and one where you had input and control.

It is seldom too late. Fairway Divorce Solutions has helped couples frustrated with the cost, time and emotional strain of using lawyers. The Fairway team encourages divorcing couples to research and understand divorce options and choose a process designed to meet the needs of both parties and the children. The court process can often be paused to allow parties to explore and use Alternative Dispute Resolutions (ADR) methods.

No, you do not need a lawyer to get divorced. However, it is highly recommended that a lawyer review your separation agreement before you sign it when children and assets are involved. Once you have a separation agreement, you do not need to use your lawyer to file for divorce. We offer divorce filing services in applicable provinces to make your life easier and keep costs down.
